Appendix – Statutory warranties and product conformity
The appendix provides information about the legal provisions governing warranties and product conformity. The main points are summarised below:
Article L.211-4 of the French Consumer Code: The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. This includes defects relating to packaging, assembly instructions or installation.
Article L.211-5 of the French Consumer Code: To conform to the contract, goods must be fit for the purpose ordinarily expected of similar goods. They must match the seller’s description and any sample or model presented. They must also have the characteristics agreed by the parties or be suitable for any particular purpose made known by the buyer.
Article L.211-12 of the French Consumer Code: A claim based on a lack of conformity must be brought within two years of delivery of the goods.
Article 1641 of the French Civil Code: The seller is liable for hidden defects that make the goods unfit for their intended use. The buyer may rely on this warranty if the defects are such that, had they known about them, they would not have bought the goods or would have paid a lower price.
Article 1648, paragraph 1, of the French Civil Code: A claim based on a hidden defect must be brought within two years of discovering the defect.
These provisions protect consumers by requiring purchased goods to conform to the contract and by allowing claims for lack of conformity or hidden defects within specified time limits.
